Petition alleges ploy to help constables get bail in custodial death case

Kochi: The mother of Udayakumar, who was allegedly tortured to death at Fort Police Station, Thiruvananthapuram, has filed a petition for including Crime Branch Superintendent of Police K.B. Balachandran and Director, Directorate of Forensic Laboratory, as additional respondents in an earlier writ petition filed by her seeking monitoring of the investigation by the court and payment of compensation to her.


In the petition, she alleged a deliberate move to delay the forensic science laboratory report on the cause of Udayakumar’s death, and attributed it to collusion between the Forensic Department and the investigation agency for helping the accused constables get bail. After collecting blood samples, forensic experts took three months to submit the report, she added.

Besides, the prosecution had not disclosed the reasons for the delay in submitting the final report within 90 days from the arrest of the accused. The Crime Branch had also made any attempt to get the report before the expiry of this statutory period.

She said though the factual report had been given to the State Government, the Crime Branch did not submit it to the court for judicial scrutiny. Prosecution of constables did not need any sanction, she added.
