Kochi, Feb 8: The Kerala High Court today stayed further proceedings against Pathanamthitta ASP Sidharth Sahney on a complaint filed by Pathanamthitta Judicial First Class Magistrate V Satheesh Kumar before the Chief Judicial Magistrate Court there. Justice J M James stayed further action on a private complaint by the ASP, taking note of the fact that the Magistrate had not obtained sanction from the Government to prosecute an IPS officer, which was needed as per Section 197 of the Code of Criminal Procedure.
The Court had also issued notice to the complainant on the revision petition filed by Mr Sahney seeking to quash the complaint. Mr Kumar filed the complaint alleging that the ASP wrongfully restrained his car and prevented him from discharging his official duty. The CJM took cognisance of the offences against the ASP and issued summons to him to appear before the Court
