HC directs arrest of police officers in custody death case

Kolkata, Feb 10: The Calcutta High Court today directed that two police officers, against whom arrest warrants were pending in a case of custodial death, be arrested immediately. Expressing surprise at the delay in execution of warrant of arrest against the two sub-inspectors of police, Justice S P Talukdar directed the additional chief judicial magistrate of Basirhat to conclude the hearing in the case as soon as possible.

It was alleged by a woman Mumtaz Bewa that her husband Abdul Hamid had been picked up by police from their residence in the middle of the night on August eight, 1999 without any arrest memo to Haroa police station in North 24 Parganas district for questioning in a dacoity case. Appearing for her, counsel Idris Ali alleged before Justice Talukdar that Hamid was tortured in custody at the police station and was admitted to Basirhat Badartala Hospital with injuries. Hamid died on August 10 that year.

A criminal case under section 304 (culpable homicide not amounting to murder) of IPC was filed against sub-inspectors Sunil Acharya and Bangshidhar Manna before the North 24 Parganas district chief judicial magistrate by Mumtaz, Ali said.In July, 2005, the additional chief judicial magistrate of Basirhat issued arrest warrants against the two SIs, but they were yet to be taken into custody, Ali claimed.The lawyer sought immediate arrest of the SIs and a direction to the lower court for early completion of hearing in the case.
