The division bench of the High Court, headed by Mr Justice P G Agarwal and Mr Justice I A Ansari, today upheld the death sentence of Mithu Kalita for criminally assaulting minor girl Jyotika.
The victim went to a marriage party when the accused took her out to a nearby bamboo grove and attempted to rape her. As the victim cried for help, he killed her and dumped the body in a nearby pond.
The family members later recovered her body and on specific information caught Mithu Kalita, who was later arrested by the police.
The High Court dismissed the appeal of the victim, upholding the death sentence with the observation that the manner in which the innocent and helpless child was subjected to repeated attempts of criminal assault and was ultimately killed was most inhuman and barbaric.
