To promote the educational advancement of the socially and educationally backward classes of citizens i.e the OBCs or of the Scheduled Castes and Scheduled Tribes in the matters of admission of students belonging to these categories in educational institutions, both aided and unaided, other than the minority educational institutions referred to in Clause (1) of Article 30 of the Constitution, Article 15 has been recently amplified by the 93rd Constitutional Amendment. The new Article 15(5) enables the Parliament as well as the State Legislatures to make an appropriate law for this purpose, for the educational institution within their respective domain.
The State Governments have been advised to device suitable laws for this purpose for the educational institutions within their domain. A proposal in this regard in respect of central educational institutions is under consideration.
